These Terms and Conditions govern your use of the Rooted N Gratitude website and your purchase or use of coaching services offered by Rooted N Gratitude, LLC (“Rooted N Gratitude,” “we,” “us,” or “our”).
By using this website, scheduling a session, submitting an application, purchasing a service, or participating in a coaching program, you agree to these Terms and Conditions.
1. Eligibility
You must be at least 18 years old and legally able to enter into an agreement to purchase or participate in our services.
2. Nature of Coaching Services
Rooted N Gratitude provides health and wellness coaching intended to support personal growth, sustainable habits, accountability, and informed decision-making.
Coaching may address areas such as nutrition, movement, sleep, stress management, menopause-related wellness, relationships, purpose, and faith. Coaching is a collaborative and educational process. You remain responsible for your decisions, actions, health, and well-being.
3. Coaching Is Not Medical or Mental Health Treatment
Kimberly Narducci is a National Board Certified Health & Wellness Coach. Unless separately stated in writing, Rooted N Gratitude does not provide medical care, psychotherapy, mental health treatment, diagnosis, prescriptions, or individualized medical treatment.
Information provided through coaching, the website, programs, resources, emails, and other materials is educational and is not a substitute for care from a physician or other licensed healthcare professional.
Do not discontinue medication, hormone therapy, mental health treatment, or another prescribed treatment without consulting the licensed professional responsible for your care.
Always seek appropriate medical attention for new, persistent, severe, or worsening symptoms. If you believe you are experiencing an emergency, call 911 or go to the nearest emergency department. If you are experiencing a mental health crisis in the United States, call or text 988.
4. Client Responsibilities
By participating in coaching, you agree to:
Provide accurate and relevant information.
Inform your coach about health conditions or professional recommendations that may affect coaching.
Consult qualified healthcare professionals when appropriate.
Take responsibility for your decisions, actions, and results.
Participate respectfully and communicate concerns promptly.
Avoid using coaching or portal messaging for emergencies or urgent medical needs.
5. Discovery Calls
A discovery call is a complimentary conversation intended to explore your goals, answer general questions, and determine whether coaching may be a suitable fit.
A discovery call is not a coaching session, medical consultation, diagnosis, or guarantee of acceptance into a program.
6. Appointments and Cancellation Policy
Private coaching appointments require at least 24 hours’ notice to cancel or reschedule.
Appointments canceled with at least 24 hours’ notice may be rescheduled without penalty. Cancellations made less than 24 hours before the appointment and missed appointments may be charged in full or deducted from a coaching package.
Exceptions for genuine emergencies may be considered at the sole discretion of Rooted N Gratitude.
If you arrive late, the appointment will generally end at its originally scheduled time. Arriving 15 minutes or more after the scheduled start time may be treated as a missed appointment.
If Rooted N Gratitude must cancel an appointment, you may reschedule it or receive an appropriate credit or refund.
7. Private Coaching Packages
Unless otherwise stated in your coaching agreement:
Package sessions are intended for the person who purchased them and may not be transferred.
A six-session coaching experience must be completed within six months of the purchase date.
Missed sessions and late cancellations may be deducted from the package.
Brief portal support does not include unlimited messaging, emergency assistance, or continuous access to your coach.
Coaching packages may include services beyond individual appointments, including action steps, educational resources, and between-session accountability.
Any package-specific terms presented during enrollment or in a signed coaching agreement will also apply.
8. Rooted in Grace Group Program
Rooted in Grace is a time-limited small-group coaching experience. Program dates, enrollment limits, fees, payment options, and included services will be disclosed before purchase.
Because group sessions occur on scheduled dates:
Missed sessions do not ordinarily include individual make-up sessions, credits, or refunds.
Participants must treat other participants with respect.
Participants may not record sessions or distribute program discussions, screenshots, materials, or identifying information about another participant without permission.
Harassment, discrimination, threatening behavior, repeated disruption, or misuse of the group may result in removal.
Rooted N Gratitude will protect information under its control as required by applicable law. However, we cannot guarantee that every group participant will maintain confidentiality. By joining a group program, you acknowledge this inherent limitation.
9. Portal Messaging
When included in a program, portal messaging is intended for brief questions, encouragement, clarification, and accountability between sessions.
Portal messaging is not monitored continuously and may not be used for emergencies, urgent medical concerns, extensive coaching conversations, or crisis support. We generally aim to respond within two business days, excluding weekends and holidays.
10. Fees and Payment
Prices are shown in United States dollars unless otherwise stated. Payments are processed through Healthie or another payment processor identified during checkout.
By providing payment information, you authorize the applicable charges, including installment payments you select. You are responsible for keeping your payment information current.
Failed or overdue payments may result in suspended scheduling, portal access, program participation, or delivery of resources until the balance is resolved.
Payment plans are installment arrangements for the total program price and are not pay-per-session subscriptions. Withdrawing from a program does not automatically cancel remaining installments unless required by law or expressly agreed to in writing.
11. Refund Policy
Unless a different written policy is presented before purchase:
Discovery calls: Complimentary; no refund applies.
Focused private sessions: Refundable when canceled at least 24 hours in advance.
Private coaching packages: A written cancellation received before the first paid coaching session may qualify for a refund. Once coaching has begun, amounts already paid are generally nonrefundable except where required by law or when Rooted N Gratitude cannot provide the purchased service.
Rooted in Grace: A written cancellation received at least seven days before the published program start date may qualify for a refund. After that deadline, program fees and payment-plan obligations are generally nonrefundable because space is limited and program preparation has begun.
Digital resources: Downloaded or accessed digital materials are generally nonrefundable except where required by law.
Promotional offers: Black Friday, Cyber Monday, founding-cohort, and other promotional purchases may have special deadlines or refund conditions disclosed with the offer. Those disclosed conditions will control.
Nothing in this policy limits a consumer right that cannot legally be waived.
12. Faith-Centered Coaching and Biblical Counseling
Services may incorporate Christian faith, Scripture, prayer, reflection, and biblical principles. Kimberly Narducci is currently completing biblical counseling certification training through the Association of Biblical Counselors, with anticipated completion by November 1, 2026.
These services are faith-based, pastoral, and educational—not psychotherapy, mental-health treatment, or medical care. When a client’s needs fall outside the provider’s training or scope, appropriate licensed care may be recommended.
13. Privacy and Health Information
Rooted N Gratitude handles personal information with care and uses Healthie as a secure client platform for applicable scheduling, payment, forms, messaging, and coaching records.
Please use the secure client portal for sensitive coaching or health-related communication instead of ordinary email whenever possible.
Our collection and use of personal information are also governed by our Privacy Policy. If Rooted N Gratitude is legally operating as a HIPAA-covered entity or business associate for a particular service, the applicable Notice of Privacy Practices and HIPAA requirements will also govern that information.
HIPAA does not automatically apply to every health coach or every coaching relationship. A separate legal review should determine whether Rooted N Gratitude is a covered entity or business associate and whether a formal Notice of Privacy Practices is required. See the U.S. Department of Health and Human Services guidance on covered entities.
We may disclose information when authorized by you, required by law, necessary to address an imminent safety concern, or otherwise permitted under applicable law and your coaching agreement.
14. Intellectual Property
The Rooted N Gratitude name, logo, website content, course materials, worksheets, videos, guides, graphics, downloads, and coaching resources are owned by or licensed to Rooted N Gratitude, LLC.
Materials are provided for your personal, noncommercial use. You may not reproduce, sell, publish, teach, distribute, upload, share, or create derivative commercial products from them without written permission.
15. Testimonials and Results
Testimonials represent individual experiences and do not guarantee that another person will obtain the same result.
Coaching outcomes vary based on personal circumstances, participation, health, follow-through, and factors outside our control. Rooted N Gratitude does not promise specific medical, physical, financial, relational, spiritual, or personal outcomes.
16. Third-Party Services and Links
The website and coaching services may use or link to third-party platforms, including Healthie. Those services are governed by their own terms, policies, availability, and security practices.
Rooted N Gratitude is not responsible for an interruption, error, loss, or action caused solely by an unaffiliated third-party service, except to the extent required by law.
17. Termination of Services
Either party may end the coaching relationship in accordance with the applicable coaching agreement and refund policy.
Rooted N Gratitude may suspend or terminate services for nonpayment, harassment, unsafe conduct, repeated boundary violations, misuse of materials, disruption of a group, or conduct that makes coaching inappropriate or ineffective.
When appropriate, we may recommend that you seek support from a licensed medical, mental health, nutrition, legal, financial, pastoral, or other qualified professional.
18. Limitation of Liability
To the fullest extent permitted by law, Rooted N Gratitude, LLC and its owner will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the website, educational information, coaching services, or participant decisions.
Any liability that cannot legally be excluded will be limited to the amount you paid Rooted N Gratitude for the specific service giving rise to the claim, except where such a limitation is prohibited by law.
19. Governing Law
These Terms and Conditions are governed by the laws of the State of Texas, without regard to conflict-of-law principles.
Any legal proceeding relating to these Terms or our services will be brought in a court with proper jurisdiction in Ellis County, Texas, unless applicable law requires otherwise.
20. Changes to These Terms
We may update these Terms and Conditions as our services or legal obligations change. The updated version will be posted with a revised “Last updated” date.
Changes will apply prospectively unless otherwise permitted by law. Material changes affecting an active paid program may also be communicated directly.
21. Severability
If a provision of these Terms is found unenforceable, the remaining provisions will remain in effect to the fullest extent permitted by law.
